Terms & Conditions – Bateel International

Bateel International reserves the right to amend, cancel or change the terms and conditions or suspend the reward program at any time without any notice and Bateel international has the sole discretion on the same.

You may register for certain activities provided through the Services. When you register or provide any other information in connection with the services, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any password and username that you are given or select, and you are responsible for all activities that occur under your password or account. Bateel International has the right to suspend or terminate any account or other registration if it suspects that such information is inaccurate or incomplete.

Reward Program

The terms and conditions of Bateel International reward program are listed below:

1. The Bateel International membership commence when the customer registers into the program using the mobile application validating the account with one time password and providing the email address along with setting up the password or similar other methods for registering the account with Bateel International.

2. The membership is valid for a period of (2) Two year from the date of joining the program. At least one purchase in 2 years is a prerequisite for successive renewal of membership

3. Bateel International reserves the right to terminate any membership without any notice at its sole discretion

4. This program is applicable across all Bateel company owned stores in UAE and KSA

5. Only one (1) membership per GSM phone number

6. The membership is non-transferable and can only be used by the authenticated / validated member. Customer needs to complete successful OTP validation on the registered number to complete authentication

7. Bateel International members are entitled to earn points on purchase of any item from boutique, café, e-commerce

8. Bateel International may at any time reject to reward or redeem points for failure to pay for the purchases or for any breach of these conditions or for any judicious reason and the member shall have no right to claim the points

9. Points cannot be transferred between member accounts. However, a member can change the number by editing the number on the mobile app and re-validating the same

10. Points can never be exchanged or transferred to cash

11. All points belong to Bateel International and may never be exchanged for goods not approved by Bateel International

12. Membership rights are reserved with Bateel international and are subject to Bateel International’ approval. A membership can be terminated in the event of a member failing to comply with these Terms & Conditions or supplying any false or misleading information to Bateel International or abusing any membership privileges or not using membership for a period of 24 months or in case of death of a member or under discretion of Bateel International for judicious reasons

13. A member may cancel his / her membership by giving Bateel international written cancellation request through email at callcentre@bateel.com

14. Member must use all points before cancelling the membership, after cancellation Bateel international will not be responsible for any points claims whatsoever

15. Bateel International shall not be responsible whatsoever for any data loss, or corruption of data or its confidentiality or the likes of the customer. No claim of whatever nature in this regard, shall lie against Bateel international either by the customer or a third party

16. Bateel International also does not take responsibility for any lost points or any claim for damage to a mobile phone as a consequence of a Bateel International membership

17. Bateel International shall not be held liable for any loss, theft, damage or unauthorized use of the mobile phones/membership/mobile app account and it is the sole responsibility of the member to ensure safety of his mobile phone, mobile app account and/or the password if any allotted to him for the purpose

18. Any loss of mobile or sim card should be intimated to Bateel International immediately failing which member is liable for loss of points and will not Bateel International for any loss occurring due to such events

19. All conditions and warranties, whether expressed or implied and whether arising under legislation or otherwise, as to condition, suitability, quality, fitness or safety of any reward supplied are expressly excluded to the full extent permitted by law.

20. Bateel International shall not be responsible in any way for technical faults by third parties and service provider as they are beyond the control of Bateel International shall at the best shall endeavor to sort out the said problem

Earning Points

1. A member may earn points on qualifying transactions after their enrollment to the reward program

2. To earn points, the member must have downloaded the Bateel International reward app and fill in the required registration details in order to activate their account

3. Earned reward points will be valid for 365 days from the date of accrual

4. Loyalty program consists of 3 tiers. Each tier has its own points allocation method

5. System will move customer tier based on the purchase history

6. Points are allocated after the successful transaction

7. 1st point will be allocated after the first transaction and can be used from 2nd transaction

Redeeming Points

Members can redeem points as an equivalent to cash as shown in the reward section

1. Members will pay any difference through card payment or cash

2. The reward can be redeemed at the in-app, in-stores of Bateel International in United Arab Emirates and Kingdom of Saudi Arabia and Bateel.com e-commerce website

3. Members must complete their profile on the Bateel International app in order to redeem rewards

4. Members must have sufficient points in their account in order to redeem the requested number of points, otherwise pay difference either through cash/card

5. Members can select the number of points to be redeemed in each transaction

Delivery

1. When member orders from a restaurant, internal system communicates the order to the selected Restaurant which is nearby to member location.

2. Each restaurant has a fixed delivery area, please note the delivery area may change at any time. Bateel international restaurants decide their own operating hours, which means that the availability of our service, and the range of available restaurants from which the member can order at a certain time, depends on the restaurants in the member’s area.

3. Upon placing an order through our App, it needs to be accepted by the selected Bateel international Restaurant. A notification will be sent to the User if the order has been accepted on the app.

4. For placing an order, member will have to provide certain details like contact number and delivery address etc. member needs to take particular care when providing these details and needs to ensure the accuracy at the time of placing an Order

5. Member must pay online for all items ordered using their account

6. Please note that our Bateel international Restaurants may operate a minimum order value policy

7. Certain products may have allergens like nuts, dairy etc.; the members can view the same in our App, if provided, while placing an order. member should contact our Bateel International call center prior to ordering if they have any allergy. Member must pre ensure that they do not order any items that they are allergic from and must directly inform the restaurant about any prevailing allergies that they may want to avoid. Member is accountable and responsible for ascertaining with the restaurants that the member is not ordering / consuming any item that may cause any allergies to the member or violates any dietary restrictions of the member

8. Member should check the product they are ordering and read its description, if provided, while placing the order. User must ensure that they are an adult and are legally authorized to order on Bateel international application. By ordering on Bateel international app the member confirms that they are an adult and accept all Terms & Conditions Bateel international

9. User indemnifies Bateel international and its subsidiaries in the event the product ordered by user does not meet member’s dietary or any other requirements and/or restrictions.

10. By ordering on Bateel international application member expresses the desire to enter into agreement with Bateel international, its subsidiaries

11. Member’s placing the order does not construe acceptance of the order.

12. Standard delivery time is anything between 45 minutes to 1:30 minutes

13. Member indemnifies Bateel international, its subsidiaries or restaurants and delivery partners for any delays in delivery which occur due to circumstances which are not in control of Bateel international, its subsidiaries or partner restaurants and delivery partners, circumstances such as, but not limited to, traffic and weather conditions, breakdown of delivery vehicle, accident, wrong address provided by user etc.

14. Bateel international, its subsidiaries delivery partners will work to ensure all deliveries are made within the promised timeframe. However, if there are any delays due to unforeseen circumstances, we will inform the member and work with the member to conclude the delivery

15. Member is responsible to provide correct delivery information while placing the order. Delivery partner will attempt delivery at the address provided by the member while placing the order. If delivery partner is not able to delivery successfully due to member’s action, then the member will be responsible for the loss of order and will be charged accordingly for such failure. Within the framework of such a case, the member must accept all legal responsibilities arising from ordering a meal to an address where he/she does not exist. Reasons member might cause a delivery to fail include but are not limited to the following:

  • Member does not come to the door to collect the order.
  • Member does not pick up the phone when the driver contacts the member using the contact information they have provided us and/or member picked up the phone but then failed to provide access within a reasonable amount of time.
  • Member is unable to guide the driver to find a safe location to leave the food in absence of user.

16. During any product delivery made by the delivery partner, if member is not available in the address specified in the system, the order placed by the member shall not be delivered anywhere else. Within the framework of such a case, the User accepts all legal and financial responsibilities arising from ordering a meal to an address where User is not available.

17. In relation to any returns, food cannot be returned, in case of missing items in the order, user must get in touch with the call center

18. Delivery periods/Takeaway time quoted at the time of ordering are approximate only and may vary from restaurants / Locations.

19. Please note, pickup/takeaway would mean where a restaurant has agreed to provide an option to the member to collect the order themselves from the restaurant. The pickup times for collection are provided by the partner restaurant and are only estimates. Not all stores provide this service

20. Bateel international and its subsidiaries, reserves the right to cancel any order without any reason whatsoever. In case of cancellation, Bateel international will notify the member that their order has been cancelled. User will not be charged for any orders cancelled by Bateel international and/or the restaurant, and we will reimburse the User for any payment already made. Accept, reject, cancel all these activities will be displayed on the application.

21. Prices include VAT and other taxes as applicable by the government and can also change at any time at the discretion of the Bateel International. member will be notified of any applicable charges and taxes prior to purchase on the checkout page on our application.

22. The final total price of order will be displayed on the checkout page, including the prices of Items, delivery fee and VAT.

23. Payment for all Items and deliveries can be made on our application by credit or debit card

24. Once the order has been confirmed the credit or debit card will be authorized and the total amount marked for payment. Payment is made directly to Bateel international

25. In an event where member has an issue with the order, User will first approach the Bateel call center at 800 BATEEL (228 335) or what’s app at +971 56 522 1237. UAE call center operational hours are between 7:30 am to 10:30 pm

26. Credit or Debit cards used in placing order on Bateel international app must belong to the user.

27. No replacement / refund / or any other resolution will be provided without Bateel call center

28. All refund requests must be communicated through Bateel call center, call center agent will assess the refund request and take a decision. Refund request will be on call center agent sole discretion

29. All refunds shall be processed in the same manner as they are received

30. The user refund procedure might take 7-14 working days to process on the debit /credit cards bank payment gateway. The user must follow up with the bank in case of any delay in crediting back the user’s account with the amount previously paid by the user.

31. Additional instructions / requests made by member while placing the order will be attempted by the restaurant on a best effort basis. Bateel international, its subsidiaries, restaurants will not be held accountable for not following these instructions partly or completely. Under any such circumstance User shall not be entitled for Refund.

32. By placing an order on Bateel international Application, member agrees to all terms & conditions including privacy policy of Bateel international including Bateel international sharing user’s details with its subsidiaries, restaurants, delivery partners, platform service providers, marketing service providers etc. in order to a seamless experience to the member and complete the delivery of the order. Member indemnifies its subsidiaries, restaurants, delivery partners, platform service providers, marketing service providers etc. for any usage of member’s details by these entities to provide seamless experience to member at the time of the order and subsequently thereof to provide member with information on new offers/products/features/restaurants/brands etc. to enhance the member’s overall experience with Bateel international Application. Bateel international its subsidiaries, restaurants, delivery partners, platform service providers, marketing service providers etc. reserves the right to analyze, interpret, use User generated data both personal and generic to create a better experience.

33. Bateel international is not liable for any information that may have become outdated since the last time the information was updated. Bateel international reserves the right to make changes and corrections to any part of the content on the app at any time without prior notice.

34. All pictures and information contained on the app are owned by Bateel international. No other party is authorized to reproduce or republish these in any format whatsoever without the prior written permission of Bateel international

35. Bateel international reserves the right to suspend/discontinue any or all products without notice, make modifications and alterations in any or all its contents, products and services contained on the App
